TrEat Me Fest Vendor Terms

I  hereby  affirm  that  I  have  been  well  advised  and thoroughly informed of the inherent hazards and policies of the event. I know that by participating in TrEat Me Fest that I am exposing myself to certain known and unknown liabilities in my direct or indirect actions with the public and guests of the event. I understand that if I choose to hire help  for the event, that I am directly responsible for their actions or injury. I hereby personally assume all risks associated with my voluntary participation in this event for any harm, injury or damage that may befall me or any employee or temporary help, as a result of my participation, whether foreseen or unforeseen.

I understand and agree that TrEat Me Fest, its parent company, its employees, members and/or directors and officers may not be held liable in any way for any occurrence in connection with my participation in TrEat Me Fest that may result in injury, death, or other damages to me or my family, heirs, or assigns, and in consideration of being allowed to participate in this event, I hereby personally assume all risks in connection with said event for any harm, injury, or damage that may befall me, including all risks connected therewith, whether foreseen or unforeseen; and further to save and hold harmless said event and persons from any claim by me, my family, estate, heirs, or assigns arising out of my participation in this event.

I further state that I am of lawful age and legally competent to sign this affirmation and release, or that I have acquired the written consent of my parents or guardians; that I understand the terms herein are contractual and not a mere recital; and that I have signed this document of my own free will. It is my intention by this instrument affirmed by my signature below to exempt and release TrEat Me Fest (DBA The Hensler Company) and its members, directors and organizers from all liability whatsoever for personal injury, employer’s liability and workers compensation, property damage or wrongful death arising out of or in the course of my participation in this event.

I HAVE FULLY INFORMED MYSELF OF THE CONTENTS OF THIS AFFIRMATION AND RELEASE BY READING IT BEFORE I AGREE TO THE TERMS.

I agree that I have read the contract and agree to comply. I commit to be a part of this event. If I do not show up I will pay a penalty of $1,000 for the cost of printed marketing materials, paid advertisement & for the promotion of my business.

*A portion of the proceeds from the event will be donated to Fight2Feed.

**In the event, TrEat Me Fest’s event company is required to obtain legal counsel or a collection agency  to enforce this agreement, said signed restaurant above shall be responsible for TrEat Me Fest legal fee, collection fees  and court costs. This contract will hold in court even if vendor changes name, management, ownership and/or closes forbusiness.

*** All food vendors must comply with local, state and federal requirements and applicable laws. Vendors are responsible for obtaining all required business licenses, permits and taxes.

RULES & REGULATIONS

BOOTH: There is no more than one brand per booth. There will be no cancellations. Failure to occupy booth space during the event will result in a $1000 fee for marketing, advertising and promotional materials. Exhibitors are responsible for keeping the space around their booth free of congestion and organized. No exhibitor will assign, sublet, or share the space allotted without the knowledge and consent of TrEat Me Fest.

SALES/PROMOTION: Any desired materials to promote the restaurant are welcomed to secure and/or result in future sales.

SET-UP/TEAR-DOWN: It is mutually agreed that it is the duty and responsibility of each exhibitor to install its exhibit/set up materials before the opening of the event. All exhibits must be staffed and must remain intact until the official closing hour. Early dismantling is disruptive to the event. All exhibitors should arrive with enough time to unload and set-up ready one hour before the event. Each exhibitor is responsible for the necessary equipment for the transportation of the food, heaters, etc. There will be a $500 late fine.

LIABILITY: TrEat Me Fest assumes no responsibility for exhibitor property or other liability. Liability insurance and property insurance are the sole responsibility of the exhibitor. The exhibitor, on signing this contract agrees to indemnify and hold forever harmless the aforementioned for any and all liability and expense for personal injury, accident, or property damage from fire, theft, destructive causes, or loss arising out of, in, at or in connection with the exhibitor’s display.

CARE OF BUILDING AND  EQUIPMENT: Exhibitors must not injure or deface the walls or floors of the building, the booths, or the equipment of the booths. Nothing will be posted on, tacked, nailed, screwed, or otherwise attached to columns, walls, floors, or other parts of the building or furniture. When such damage appears, the exhibitor is liable to the owner of the property so damaged. All materials used in decoration must be flameproof. Combustible materials or explosives are not permitted.

DRESS CODE & CODE OF CONDUCT All exhibitors and their staff working their booth must comply. Required dress is professional business attire. No clothing that may be interpreted as promiscuous, provocative, or overly suggestive. TrEat Me Fest reserves the right to deem any attire inappropriate and therefore request appropriate dress is followed. TrEat Me Fest may revoke without refund the privilege of any exhibitor in the event such exhibitor participates in any provocative or other inappropriate behavior in sole judgment of TrEat Me Fest.
